Since we published our blog post about the upcoming September 9th FDA deadline that will be forcing most vape flavors into retirement, we've received many questions from customers wanting to know more details. In an attempt to answer those questions, we've created this blog post to serve as a live Q&A. 

We've answered some of the most common questions we received below. If you have another question, just leave it as a comment and we'll answer it and add it to this post!

I love Kai's Virgin Vapor. Is there anything I can do to help you survive?

Yes, and thank your for asking!

First, please stock up on the flavors that will disappear in September. You'll be able to enjoy your flavors even after the deadline and every cent helps us as we struggle to afford our PMTA. We are putting every last penny that we have into this effort and we've got hundreds of thousands of dollars in lab testing bills alone coming due over the next couple months so every purchase helps!

How long will vape juice last before it goes bad? What's the best way to store it if I want to stock up?

The expiration date on our bottles is two years after the date of manufacture. However, our vape juice really doesn't go "bad" unless it is exposed to prolonged, direct sunlight (for example, if you leave it in a hot car over the summer!). We have some vintage bottles of Kai's Virgin Vapor that are as much as 6 years old. Amazingly, they still taste, smell and vape just fine! So our vape juice doesn't go "off," what will happen is that the nicotine will gradually degrade over time resulting in slowly sinking nicotine levels.

The best way to slow this process is to keep any e-liquid you want for long term storage in the freezer. The cold temperature will slow down the process of nicotine degradation. It won't stop it completely, but it will buy you extra time!

If you want to be really crafty, you could get e-juice with a nicotine level higher than you normally vape knowing it will be lower by the time you get to it in a couple years.    : )

My favorite flavor isn't on the PMTA list! Will you please reconsider?

Sadly, no. We're committed to the 20 candidates for the PMTA and this list will be further reduced to 10 in the next few weeks. Unfortunately, we just can't afford to save more than 10 flavors and we've already had to make some hard choices as well as pony up for the first rounds of lab testing. We wish we could add more flavors but we just can't change course at this point. There were a lot of factors that led to our selection of the 20 candidates and we truly wish we could save more of our flavors!

Can you just sell the flavoring separately after the PMTA so I can keep vaping my favorite flavor?

Unfortunately, no. The FDA saw this sneaky work around coming from a mile away and specifically defined e-juice to include any component that is reasonably expected to be added to vape juice. So, sadly, we won't be able to sell flavors separately after the September 9th deadline.

Can Kai's Virgin Vapor add more flavors after the PMTA?

Yes! If we are successful in our PMTA application, we would be able to bring back additional flavors in the future provided we were able to create PMTA's for them as well. So, this would be conditional upon us surviving the PMTA and recovering financially enough to be able to afford additional PMTA's in the future. We don't foresee this happening until at least a year after the PMTA deadline but it is definitely a possibility in the future!

I don't understand. I thought the FDA just banned flavored vape pods. Why is this still happening?

The ban on flavored vape pods was an interim action by the FDA in response to calls for an immediate, country wide ban on all vape flavors. Fortunately, they decided to only ban flavored vape pods and allow open system e-juice flavors to continue to try to stay in business by going through the PMTA process.

The PMTA stands for Premarket Tobacco Product Application. It is required by the FDA and the deadline was drastically accelerated last year by a court case brought by the American Academy of Pediatrics against the FDA. The PMTA is completely different from the flavored vape pod ban and remains in effect and due on September 9th.

Because of the extremely high cost, few vape companies will be able to afford it and it remains very uncertain whether the FDA will accept the applications of those companies that do try to comply due to the regulatory complexities of the PMTA process and lack of any clear pass/fail guidelines. The FDA will have a huge amount of leeway to reject or accept any PMTA submitted because there are no set parameters that a company must meet that would guarantee acceptance. In other words, it's up to the FDA what they want to accept or reject.

Will Kai's Virgin Vapor still have nic salts available after the deadline?

No. It is doubtful that the FDA will approve any PMTA's for nic salts and Kai's Virgin Vapor is not going to even try as success seems so unlikely. All of our nic salt vape juices will no longer be available after September 9th.

Will your CBD line still be available?

We will still be able to offer our line of CBD products after September 9th, however, this will be dependent on our PMTA applications being accepted by the FDA. If our PMTA is not accepted, we will not be able to afford to stay in business and will have to close down completely, including discontinuing our CBD line. The CBD line is relatively new and we have not had enough time to develop it for it to be able to support company operations on its own.

Also, if you are waiting for our CBD vape juice to be in stock, we apologize for the delay! The coronavirus shut downs in California have frozen our ability to bring out this product line but we do intend to make it available as soon as we can!

What flavors will still be available after September 9th?

We have 20 flavors that are on our list of candidates to submit to the FDA so they can remain available after September 9th.

Please keep in mind that this list will be cut in half in the next few weeks as we can only afford to take 10 flavors through the entire PMTA.

Please understand that we share your sorrow if your favorite flavor is not on this list! We wish we could save all of our wonderful flavors but, sadly, this is far beyond our means and we simply cannot afford it!

We will post the final list in a few weeks but expect to see half of these flavors drop out as we narrow it down to the final 10. If your favorite flavor is not on the list, we are sad to say that it will no longer be available starting on September 9th of this year.

I only use zero nicotine, mint/menthol, and vegetable glycol. Like what I’ve gotten from this company. They stand behind their product. Cannot get vegetable locally. Get a bad headache from propyl9 glycol ejuice.

I had initially tried commercially available products with less than satisfactory results due to their artificial ingredients. you were a blessing when I found you and I’ve never had any health issues with your products. I am sad we are losing our freedoms due to corrupt bureaucracies (Monsanto/FDA). I thank you for all your help and hope someday we can be free together again. I will be missing cherry on top and blackberry vanilla the two of which I mixed with death by chocolate. I have supported you for about six years and I will continue to wish you and all Americans Peace and freedom for a brighter future.

About 10 years ago my best friend and her son opened a vaping store in our little town. Adam is brilliant and was able to produce the liquid in a lab that was set up next to his shop. It was very successful until the State started trying to raise taxes to a ridiculous level. Once the store was closed, I was frantic to find another place to get my e-liquid. I tried a lot of them, and wasn’t happy with the taste or the ingredients. Then I found Kai’s Virgin Vapor when I Googled “alcohol free e-liquid” and their name came right up. I have been a happy customer for years and since my husband finally decided to give it a try, we found a flavor that was perfect. I would hate to think that we would lose our ability to vape and possibly go back to smoking. I have never felt better and I’m sure he will be on his way to better health too. This company is a literal life-saver for many people.

I have been vaping for 10 years after smoking for 30. Repeat: I haven’t smoked a cigarette in 10 years after smoking for 30 years. That’s huge! And I recently had a chest x-ray that showed no sign of any problem. No more smoker’s cough, either!

I started with another brand of juice, but I switched to Kai’s Virgin Vapor about five years ago because it contains only vegetable glycerin and uses organic ingredients. Most other brands contain propylene glycol and artificial flavors, which made my husband cough and irritated my throat. Neither of us have ever had issues with Kai’s juice.

I’m delighted to see that The Jet Set is on your list of flavors to keep. I hope it makes it through the final cut.

I have bought my vape juice exclusively through you since moving from cigarettes to vaping. After trying a few flavors the first few times to see what I would like I came across Celestial Honeydew. I have bought that flavor since and only that flavor.
It would be devastating to me to have no where to turn for vape liquid. To say I’m madder than hell at the government and their overreach is an understatement. I truly hope your filing is accepted and approved.
